0. OBJECT

These General Terms and Conditions govern the purchase of the products offered on the website https://staging.scilabsnutrition.eu/, which is owned by SCILABS NUTRITION EU, BV (hereinafter, “SCILABS NUTRITION”).

The purchase of any of the products implies the full and unreserved acceptance of each and every one of these General Terms and Conditions, without prejudice to the acceptance of any Specific Terms and Conditions that may apply to the acquisition of certain products. These terms apply both to sales to end consumers (B2C) and, where applicable, to sales to businesses (B2B).

Our website allows for guest checkout, without the obligation to create an account, so that the customer can place an order by providing only their personal data necessary for delivery.

Our e-commerce platform complies with European Union legislation (Directive 2011/83/EU on Consumer Rights, Directive 2000/31/EC on Electronic Commerce, Regulation (EU) 2016/679 – GDPR – and applicable food regulations) and the relevant Dutch legislation. In particular, consumers are informed of all essential conditions (product characteristics, final price, payment, delivery, right of withdrawal, etc.) as required by the EU Consumer Rights Directive. Furthermore, our terms are aligned with the Dutch Civil Code (Burgerlijk Wetboek) regarding sales and distance contracts.

These General Terms and Conditions may be amended without prior notice; therefore, it is recommended to carefully read their content before purchasing any of the offered products.

All notifications and communications between users and SCILABS NUTRITION shall be considered effective for all purposes when made through any of the contact methods listed above.


3. PRODUCTS AND CHARACTERISTICS

The products offered, together with their main features, ingredients, and price, are displayed clearly and understandably on the website.

Food supplements comply with EU regulations: they include labeling with the recommended daily intake, the warning that “they should not be used as a substitute for a balanced diet”, and an indication to keep the product out of the reach of children. They also do not include any medicinal claims, in accordance with European Commission standards.

The buyer is responsible for following the usage and storage instructions indicated on the product packaging and accompanying documentation. The seller shall not be liable for any damages arising from misuse, improper storage, or handling of the product by the buyer.

SCILABS NUTRITION reserves the right, at any time, to decide which products and/or services are offered to customers. Accordingly, SCILABS NUTRITION may, at any time, add new products and/or services or withdraw any currently offered products without prior notice.To access and purchase the products on https://staging.scilabsnutrition.eu/, the user must follow all instructions provided during the purchase process, which implies reading and accepting all applicable general and specific terms and conditions.


4. AVAILABILITY AND SUBSTITUTIONS

SCILABS NUTRITION aims to ensure the availability of all products advertised on https://staging.scilabsnutrition.eu/. However, if any requested product is unavailable or out of stock, the customer will be informed via the website, which will display a notice indicating that the product is out of stock. The website shows real-time stock levels.

If a product is unavailable and the consumer has been informed, SCILABS NUTRITION may supply an equivalent product at no additional cost, in which case the consumer may accept or reject it by exercising their right of withdrawal and contract termination.

No substitute product shall be shipped without the buyer’s express consent, especially in the case of food products subject to specific labeling requirements in the destination country.

In the event of unavailability of the entire order or part thereof, and the rejection of substitute products by the customer, any prior payment shall be refunded using the same payment method.


5. PURCHASE PROCESS

To make any purchase on https://staging.scilabsnutrition.eu/, the customer must be an adult.

The steps to complete a purchase are:

  1. Select the products and add them to the shopping cart, or complete the purchase directly using instant payment methods (e.g., Google Pay, Apple Pay).
  2. If the purchase is not completed using instant payment methods, the customer must fill out the form providing the necessary data (name, shipping address, payment method details, etc.).
  3. Review the information entered in the form and, if correct, confirm the order.

The final order price, including VAT and shipping costs, will be detailed during the purchase process.

It is also recommended that the customer print and/or retain a copy in durable form of the terms of sale at the time of placing the order, as well as the confirmation receipt sent by SCILABS NUTRITION via email.


6. INVOICING

Along with the order, the customer will receive the corresponding invoice with VAT at the rate applicable in the destination country.

The customer consents to receive such invoice in electronic format, which will be sent via email after the purchase.


7. PRICES, COSTS, AND TAXES

The prices of the products listed on https://staging.scilabsnutrition.eu/ are expressed in euros unless otherwise indicated, and are guaranteed for their period of validity, except in the case of typographical errors, regardless of the order destination.

The final prices of all products (and, where applicable, unit prices when mandatory) along with their features, offers, discounts, etc., are reflected in each item displayed on the website.

The prices displayed do not include VAT. Since sales are made to consumers across Europe, VAT is applied based on the destination country, in accordance with the EU One-Stop Shop scheme for B2C sales.

Shipping costs, calculated according to destination and order weight or amount, are also displayed before completing the purchase.

Offers or discounts are applied before calculating VAT.

Product prices may vary at any time. In such cases, the price applicable will be the one in effect on the order date. In any event, the final cost will be communicated to the customer during the online purchase process before formal acceptance.


8. PAYMENT METHODS

The following payment methods are available:

  1. Credit or debit card: Immediate payment via the secure STRIPE platform.
  2. Bank transfer: Payment may be made to one of the bank accounts indicated during the payment method selection. The customer must indicate their name and order number in the transfer reference.
  3. Other electronic payment methods, such as Google Pay or Apple Pay, managed securely through the STRIPE platform.

In the event of a refund, it will be made using the same payment method used for the purchase.


9. DELIVERY, METHODS, AND TIMEFRAMES

Orders will be delivered to the address provided by the customer at the time of purchase. Delivery is available throughout the European Economic Area (EEA).

Shipments are made via external courier companies. 

Delivery usually takes 2 to 5 business days, depending on the destination country. The maximum delivery period is 30 days from order confirmation. If delivery cannot be completed on time for reasons beyond the customer’s control, the order may be canceled with a full refund.

In exceptional cases of product unavailability, the customer will be informed as soon as possible. In such cases, an equivalent product may be offered at no additional cost, or the customer may cancel the order with a refund.

The seller shall not be liable for delivery delays or failure due to inspections, controls, detentions, or blocks by customs or health authorities in the destination country, provided these actions are in accordance with applicable laws or regulations.

Return shipping costs shall be borne by the customer unless the error is attributable to the seller.


10. RIGHT OF WITHDRAWAL (B2C RETURNS)

In accordance with Directive 2011/83/EU, consumers (private customers) have the right to withdraw from the contract within 14 calendar days without giving any reason and without incurring any costs, except for return shipping.

The customer has a maximum of 14 calendar days from the day of receipt of the product to inform SCILABS NUTRITION of their decision to withdraw.

Withdrawal implies that SCILABS NUTRITION will refund the amount paid by the customer within a maximum of 14 calendar days, using the same payment method selected by the customer. 

SCILABS NUTRITION may, however, withhold the refund until the returned goods have been received and inspected. Returns are subject to receipt and inspection of the products by the seller to ensure that they are in the same condition as delivered and have not suffered any depreciation due to improper use. If such depreciation is found, the seller may deduct the corresponding amount from the refund.

During this period, the consumer shall inform the entrepreneur of his decision to withdraw from the contract by filling in the form which can be downloaded below, completing it and sending it to the SCILABS NUTRITION e-mail address: info@scilabsnutrition.eu.

Any clear communication of the withdrawal via email shall also be valid.

SCILABS NUTRITION shall acknowledge receipt of the withdrawal in a durable medium.

Products must be in perfect condition, in their original packaging, with all accessories, and unused to be eligible for return.

The customer will bear the costs of returning the goods.

Exceptions: The right of withdrawal does not apply to products specified by law (e.g., perishable goods or products unsealed for hygiene or health reasons). In particular, perishable foodstuffs and dietary supplements whose original seal or packaging has been opened cannot be returned if their condition prevents reuse by another consumer. Breaking the seal or using the product beyond examining its characteristics will void the right of withdrawal (except in cases of non-conformity). SCILABS NUTRITION reserves the right to reject returns of goods not in perfect condition or not in their original packaging with all accessories.


11. WARRANTY OF CONFORMITY AND LIABILITY

By law (Directive 2019/771/EU), goods sold to consumers have a statutory warranty of conformity of at least two years from delivery. This means the product must conform to the contract (have the advertised qualities, function properly, etc.) during that period. If a defect appears or the product does not match the advertised characteristics, the consumer may demand repair, replacement, price reduction, or contract termination at no additional cost.

For food products and dietary supplements, the statutory warranty is limited to the period indicated by the expiration or best-before date on the packaging, which shall not exceed two years. Claims for products consumed or opened after this date, or improperly stored, will not be accepted.

If a product is defective within its best-before period, the consumer may request repair (if applicable), replacement, or refund at no cost.

For sales to businesses, professionals, or distributors (B2B), the statutory warranty of conformity does not apply unless expressly agreed in writing. In such cases, the buyer assumes responsibility for checking the condition and conformity of the products upon receipt and before resale or use. Dutch Civil Code rules (Burgerlijk Wetboek, Books 6 and 7) apply to B2B sales.

The buyer is solely responsible for ensuring that distribution, labeling, marketing, and promotion of acquired products comply with applicable regulations in the destination country(ies). The seller shall not be liable for penalties or claims arising from the buyer’s non-compliance.

Limitation of liability: Except as required by law, the seller shall not be liable for indirect damages, loss of profits, lost business opportunities, or other economic losses that are not a direct and immediate consequence of contractual non-performance. The seller shall also not be liable for damages arising from improper, non-compliant, or unintended use of the product..


12. DATA PROTECTION

The processing of the customer’s personal data is carried out in compliance with Regulation (EU) 2016/679 (GDPR) and the Dutch implementation law (Uitvoeringswet AVG). Personal data are used solely for order management and compatible purposes (e.g., customer service, handling claims). Appropriate technical and organizational measures are in place to protect customer information.

The customer has the following rights with respect to their personal data: access, rectification, erasure, restriction, portability, and objection, which may be exercised by contacting SCILABS NUTRITION.

For commercial communications (e.g., newsletters, promotions), the requirements of the ePrivacy Directive are fully respected, and such communications are only sent with the prior consent of the user.Additional information regarding data protection can be consulted in the Privacy Policy, available at the footer of this website.


13. CUSTOMER SERVICE AND COMPLAINTS

To lodge any complaint or claim with SCILABS NUTRITION, the customer should contact the customer service department either by telephone on +31 970 10 280840, or via the e-mail address info@scilabsnutrition.eu, or by filling in the form that can be downloaded below, filling it in and sending it to the same e-mail address:

If the complaint is not resolved satisfactorily, the customer may resort to alternative dispute resolution methods, such as mediation or arbitration, under European law. Customers are advised to explore options available in their community or through private ADR bodies.

Amicable dispute resolution: Before initiating any legal action, the parties agree to attempt to resolve any dispute through friendly negotiation for a minimum period of 30 days from written notification. For consumers, if no agreement is reached, they may resort to recognized ADR entities in their country of residence or to the European Consumer Centre (ECC-Net), which provides free assistance for cross-border claims within the EEA.

Note: The EU Online Dispute Resolution platform has ceased operations as of March 20, 2025.


14. INTELLECTUAL PROPERTY

All content, trademarks, logos, texts, images, and designs on the website are the exclusive intellectual property of the seller or third parties who have authorized their use. Any reproduction, distribution, public communication, or unauthorized use of such content is strictly prohibited without the express written consent of the rights holder.


15. APPLICABLE LAW AND JURISDICTION

These terms shall be governed by Dutch law (Dutch Civil Code) and applicable EU legislation. Mandatory minimum consumer rights under the laws of the buyer’s country of residence within the EEA shall be observed (Article 6.2, Regulation (EC) No 593/2008, Rome I).

In the event of a dispute, the parties submit to the competent courts of the Netherlands, except that consumers, as the weaker party, may invoke any other jurisdiction under the law of their country of residence.

All clauses shall be interpreted so as not to limit the mandatory minimum rights of the consumer under the legislation of their habitual residence, in accordance with Regulation (EC) No 593/2008 (Rome I).
